Special Prosecutor's Office decides not to initiate pre-trial proceedings against Minister of Culture Boil Banov

Sofia. On April 11, 2019, the Special Prosecutor's Office decided not to initiate pre-trial proceedings against Minister of Culture Boil Banov for lack of evidence of a crime, said the Appellate Prosecutor's Office.
Copies of the decision were sent to the whistle-blowers – the Bulgarian Socialist Party represented by the President of its National Council Kornelia Ninova, MP Elena Yoncheva and Grigor Zdravkov. The reports sent to the prosecutors contained media publications citing Elena Yoncheva, who alleged Minister of Culture Boil Banov to have released a company from the liability to pay BGN 700,000 in damages for delays. The company was the executor of the restoration and construction works during the second and third phases of the project for exhibiting the remains of the ancient city of Serdica located at the so called Sofia Largo.

Sofia. The check on the Banov case was not a personal investigation but a standard procedure, Deputy Prime Minister Tomislav Donchev said, quoted by BNR. It is done whenever there is suspicion of misappropriation of EU funds. Such information had been sent to the Prosecutor’s Office in previous instances as well, Donchev said.
“The case here is a bit different. Since the case is a public sensation, since I know that the prosecuting authorities are working, I decided that everything that was available at the administrations such as documents, inspections, reports, etc., would help the prosecutor’s office for the purposes of the investigation or preliminary investigation under way,” the deputy prime minister explained.
Tomislav Donchev stressed that he sent the documents to the prosecutor’s office in his capacity of Deputy Prime Minister responsible for EU fund absorption.
He declined to comment on the content of the documents.

Sofia. The preliminary probe into the Banov case will be extended, as Deputy Prime Minister Tomislav Donchev sent additional documents to the Prosecutor’s Office yesterday, Prosecutor General’s Spokesperson, Rumyana Arnaudova, told Focus News Agency. While checking the case himself the deputy prime minister requested documents from different ministries which he then sent to the prosecutor general. The prosecutor who conducts the probe had already collected written explanations, documents, the audio file and an expert’s report and was to make the conclusion this week, but now the probe will have to be extended for the documents to be examined and any subsequent investigative actions, Arnaudova said. “We cannot comment in what capacity, why and within what powers the deputy prime minister made a check, but anyway those documents were sent to the prosecutor’s office and we are obliged to analyse them, compare them to know if we already have them and do an additional legal analysis,” she said.

The BSP expect a serious investigation by OLAF and by the Bulgarian Prosecutor’s Office into the Banov case, the spokesperson for the BSP MPs, Elena Yoncheva, said to reporters after the group notified OLAF, Focus News Agency reports. “The case is too clear, the recordings are indisputable. Also, the documents we have collected prove that what Mr. Banov requested from his administrators as well as from a company representative and an independent construction supervisor did happen,” Yoncheva added. Asked if the return of money might be required, she replied: “I cannot say that.” Asked if she worried that the findings of the Bulgarian Prosecutor’s Office and OLAF might differ, Yoncheva said: “I think the case is perfectly clear. The evidence is indisputable, both the documents and the audio file. I have no doubts that these conclusions will coincide.”

Minister of Culture Boil Banov said he would continue working during the preliminary probe into his conduct as deputy culture minister following allegations that he then spared a contractor a penalty of BGN 700,000 for a delay. Banov told BTV that he had spoken with Prime Minister Boyko Borissov. “We talked, I explained the situation to him, he said go, work, carry on, after the check we will see,” the minister said. Banov claims that the man who taped him, a former employee in the ministry, began to threaten him after his dismissal. He also claims that the recordings were manipulated. “Doctored, rigged, cut, mixed with other conversations so that I be blackmailed,” the minister said.

BSP MP Elena Yoncheva told reporters in Parliament that she is waiting for the Prosecutor’s Office to contact her and she is ready to give all the information she has about the Banov affair. “We are ready to notify the prosecutor’s office on the affair, [but] the prosecutor’s office took notice the moment we revealed the information on that affair,” explained Yoncheva, who is spokesperson for the BSP group in Parliament, quoted by Focus News Agency.

Sofia. Prosecutor General Sotir Tsatsarov took notice and ordered a probe in connection with the clues to corruption implicating Minister of Culture Boil Banov at the time when he was deputy minister, the Prosecutor’s Office said. According to information presented at a press conference by BSP MP Elena Yoncheva, the then deputy minister, Boil Banov, spared a construction contractor a penalty of BGN 700,000. The Special Prosecutor’s Office will request the entire documentation on the project (Largo, Serdika complex, phase 2-3) and will interrogate anyone who has something to do with the case.

As deputy minister of culture, Boil Banov negotiated schemes to the detriment of the state, giving instructions on how to counterfeit documents for the construction of the Largo, the Serdika complex, phase 2-3. This is what BSP MP Elena Yoncheva told a press conference at the headquarters of the party, Focus News Agency reports. A recording played at the press conference indicates that the then deputy minister, Boil Banov, now minister, spared the contractor a penalty of at least BGN 700,000. Banov was recorded talking to ministry employees in his office.
