Investigation of corruption in Sofia’s Mladost district is over

Sofia. The Special Prosecutor’s Office has finished the investigation of corruption against Mladost District Mayor Desislava Ivancheva, Deputy Mayor Bilyana Petrova and former mayor Petko Dyulgerov, the Prosecutor’s Office said. In the last two days, the charges, refined during the pre-trial proceedings, were brought to each of the three. From today, the materials in the case will be turned over to the indicted and their lawyers. The case will be sent to court as soon as possible. The three were detained in Sofia on April 17 after receiving EUR 70,000. The investigation took less than 3 months, the press release reads.

Sofia. The Special Court of Appeal decided that Mladost District Mayor Desislava Ivancheva who was accused of corruption should remain in custody, bTV reports.
However, the court did not accept the prosecution’s claim that there was a risk that she might commit another crime.
The investigation is over and the evidence will be presented to the defence next week.
Within 2 months, the case should be brought to court.

Sofia. The Special Appellate Court postponed to next Tuesday the case against Mladost district Mayor Desislava Ivancheva and her deputy Bilyana Petrova, the Bulgarian National Radio reported. The court was supposed to decide today whether the two should be removed from office. They, however, requested time to get acquainted with the case files and the court rescheduled the trial to next Tuesday.
Desislava Ivancheva, Bilyana Petrova and former district mayor Petko Dyulgerov have been in custody for more than a month over charges of asking and receiving a bribe. The prosecutors asked for temporary suspension of their powers after it became clear that while in custody Ivancheva issued a dismissal order for Deputy Mayor of Mladost Rumen Rusev, who is one of the main witnesses against her. The prosecutors interpreted it as an attempt to pressure the witness into withdrawing his testimony. Ivancheva argued that her decision was in line with the law, and the prosecutors’ actions were seeking “her political destruction”. According to the prosecutors, Rusev was fired so that Bilyana Petrova is appointed as an acting mayor and Ivancheva continues de facto to run her office, even if still in custody and charged with bribery. Petrova is regarded as an accomplice to Ivancheva in the extortion of businessman Alexander Vaklin.

Sofia. Today, the Special Prosecutor’s Office has filed a request for removal from office of the mayor of Sofia’s Mladost district, Desislava Ivancheva, who has been remanded in custody on charges of receiving large-scale bribery, the Prosecutor's Office said.
The prosecutors found that in the detention facility where she is being held in custody, Ivancheva has been handling documents in her capacity as mayor, then sending them to the municipal administration through persons with permission to visit. In so doing, she has been effectively exercising her powers, despite being held on remand.

Sofia. For two years, we haven’t received a single report by Ms Ivancheva on a concrete decision, Sofia Mayor Yordanka Fandakova told bTV, referring to the mayor of Mladost district, who was arrested on charges of large-scale corruption last month. According to Mayor Fandakova, Mladost has long been experiencing difficulties in implementing municipal projects. The reminder letters for delayed files sent to Mladost have been on average twice as many as in other areas.
“Ms Ivancheva and Mr Klisurov were part of the citizens protesting two years ago against the construction of a building that we all agreed was in the wrong place. I said back then that these problems should be solved individually. Instead, they got locked in drawers,” the mayor said, adding that for two years not a single report on a specific case with a proposal for a specific solution was received by the Municipality.

Sofia. “I have never made a comment that the arrest has crossed the limits. Ask those who have said it,” Prosecutor-General Sotir Tsatsarov said in response to a reporter’s question whether the arrest of the mayor of Sofia’s Mladost district, Desislava Ivancheva, was unnecessary spectacular, Focus News Agency reports.
He said justice is achieved by observing the law and those who enforce the law cannot be reproached because the law is as it is. “I will not repeat what some have said: “You wanted a Romanian model – you got one.” This is not a Romanian model, it is simply observing the law. People who applauded the images of handcuffed Romanian ministers and mayors now take stands that suggest either poor memory or a very rapid change in their personal political views,” said the prosecutor-general. “The way in which an arrest is made does not depend on having or not having rights but on the provisions of the Criminal Procedure Code,” he noted.

Sofia. We have passed on information about other blackmailed persons related to the Mladost case to the prosecutors, said Plamen Georgiev, Chair of the Commission for Counteracting Corruption and Forfeiture of Illegally Acquired Property, Focus News Agency reports.
Commenting on the law enforcement operation on 17 April against the Mayor of Sofia’s Mladost district, Desislava Ivancheva, Georgiev said the law was strictly observed. He refused to reveal whether there were other businessmen who had given similar reports about Ivancheva, explaining that the anti-corruption commission had only powers to investigate, from the moment of detention only the prosecutors could give public information on a case. Nevertheless, he confirmed there were other similar cases.

Sofia. I ask the Court to be released for lack of evidence, said Mayor of Mladost district Desislava Ivancheva when given the last word in court, Focus News Agency reports. She added that she would not attempt to hide.
Ivancheva’s deputy, Bilyana Petrova, said at home she would be more useful to the public. She promised she would not interfere with the investigation.
Ivancheva's lawyer Marin Markovski said at the hearing that according to him the prosecution failed to provide evidence that a bribe of BGN 500,000 had been asked. In his words, the prosecutors’ case is not based on evidence. Markovski said there was no reason why Ivancheva should remain in custody.
The court is expected to give a ruling at 5.45 p.m. on the measures to be imposed on the three defendants – Desislava Ivancheva, Bilyana Hristova-Petrova and Petko Dyulgerov.

Sofia. The mayor of Mladost district, her deputy and a former deputy mayor of the district have been charged with large scale bribery, head of the Special Prosecutor's Office Ivan Geshev said at a press briefing in reference to the yesterday’s arrest of Mayor Desislava Ivancheva, Focus News Agency reports.
“The accused were detained for 24 hours under the Ministry of the Interior Act. The punishment for this type of crime is imprisonment from 10 to 30 years, confiscation of part or all of the property, revocation of rights," said Ivan Geshev.
“The pre-trial proceedings were initiated in February and the investigation into trading in influence has been carried out since early December. It concerns multiple reports about unlawful activities in Mladost municipality, in particular the actions of Mayor Ivancheva," he said.

Sofia. The Mayor of Mladost neighbourhood, Desislava Ivancheva, remained handcuffed next to her car over four hours while the car was searched in the city centre, at the intersection of Vasil Levski Blvd. and Gen. Gurko St., a Focus News Agency reporter said. She was then taken by the police to a nearby building and the car was picked up.
According to unofficial information, the mayor requested EUR 70,000 to issue a construction permit. She was not allowed to talk to reporters.
The Special Prosecutor’s Office together with the anti-corruption body is investigating corruption in Mladost Municipality, Rumyana Arnaudova, Spokesperson of the Prosecutor General, told Focus Agency earlier today. More details will be presented tomorrow. Speaking to reporters, the head of the Special Prosecutor’s Office, Ivan Geshev, declined to disclose details about the investigation.
Lawyer Varban Varbanov was allowed to approach Ivancheva at about 5.30 pm. Earlier he told reporters that he knew nothing about the investigation for the moment and had not talked to Ivancheva.
There is no official information about any other detentions.
Sofia Mayor Yordanka Fandakova said she had no information other than the media reports. Sofia Municipality has only been alerted about delayed proceedings in Mladost.
